Terms & Conditions
By confirming a booking, you acknowledge that you have read, understood, and agreed to the terms outlined below.
1. Booking and Payment
- A deposit is required at the time of booking to confirm your reservation.
- The balance must be paid in full 15 days before the departure date.
- Brucks Safaris reserves the right to cancel any booking that is not fully paid within the specified time frame.
- Prices are quoted in USD and are subject to change due to government taxes, park fees, fuel costs, or supplier rate changes.
2. Cancellations and Refunds
- All cancellation requests must be made in writing via email.
- More than 60 days before departure: 90% refund.
- 35–59 days before departure: 50% refund.
- Less than 35 days before departure: No refund.
- Certain third-party services (e.g. airlines, hotels, lodges) may have stricter policies which override the above.
- No refunds will be issued for unused services, early departures, or no-shows.
3. Travel Documents and Entry Requirements
- Travelers are solely responsible for ensuring they have valid passports, visas, and vaccinations.
- Brucks Safaris is not responsible for delays or denied entry due to incomplete travel documentation.
4. Itineraries and Changes
- Brucks Safaris reserves the right to modify routes or schedules due to weather, safety, or political events.
- Any changes will be made in the best interest of the traveler and the overall experience.
5. Liability and Responsibility
- Brucks Safaris acts as an agent for third-party service providers and is not liable for their negligence.
- Participation involves inherent risks including wildlife encounters and terrain hazards; travelers participate at their own risk.
6. Health, Fitness, and Safety
- Travelers must be physically fit for their itinerary; medical clearance may be required for high-risk activities.
- Pre-existing medical conditions or allergies must be disclosed at the time of booking.
7. Travel Insurance
- Comprehensive travel insurance is mandatory for all travelers.
- Insurance should cover medical expenses, emergency evacuation, and trip cancellation.
8. Force Majeure
- Brucks Safaris is not responsible for cancellations caused by natural disasters, pandemics, or government restrictions.
9. Use of Images and Media
- We reserve the right to use photographs and videos taken during tours for marketing purposes.
- Notify us in writing before the tour if you do not wish to appear in promotional material.
11. Wildlife and Conservation
- Wildlife sightings cannot be guaranteed; feeding or harassing wildlife is strictly prohibited.
- Travelers must comply with park rules and conservation regulations at all times.
13. Governing Law and Jurisdiction
- These Terms are governed by the laws of Kenya, and disputes are subject to the exclusive jurisdiction of Kenyan courts.
